This article has the scope to analyze the influences left by Hans Kelsen and his Teoria Pura do Direito for legal hermeneutic sand the uncertainties still present in his classic book on the interpretive process. Positivism kelseniano, recognized by the separation between law and morality, not omitted as to the reality of legal interpretation, and, without disregarding their theoretical bases, left guidelines for the consolidation of a theory of interpretation. Kelsen developed the concept of legal frame as a limit to (...) the authentic interpreter of the rule whose subjectivity influence the interpretative process,but also saw interpretations outside this frame. The cognitive reserve is widely accepted as the active ability to cope with brain damage, using preexisting cognitive and compensatory processes. The common CR proxies used are the number of formal years of education, intelligence quotient or premorbid functioning, occupation attainment, and participation in leisure activities. More recently, it has employed the level of literacy and engagement in high-level cognitive demand of professional activities. This study aims to identify and summarize published methodologies to assess the CR quantitatively. We searched for (...) published studies on PubMed, ScienceDirect, and Web of Science between September 2018 and September 2021. We only included those studies that characterized the CR assessment methodology. The search strategy identified 1,285 publications, of which 25 were included. Most of the instruments targeted proxies individually. The lack of a gold standard tool that incorporates all proxies and cognitive tests highlights the need to develop a more holistic battery for the quantitative assessment of CR. Further studies should focus on a quantitative methodology that includes all these proxies supported by normative data to improve the use of CR as a valid measure in clinical contexts. (shrink)

Humans have developed the capacity to approve or disapprove of the behavior of their children and of unrelated individuals. The ability to approve or disapprove transformed social learning into a system of cumulative cultural inheritance, because it increased the reliability of cultural transmission. Moreover, people can transmit their behavioral experiences (regarding what can and cannot be done) to their offspring, thereby avoiding the costs of a laborious, and sometimes dangerous, evaluation of different cultural alternatives. Our thesis is that, during ontogeny, (...) the evaluative communication (approval/disapproval) between parents and offspring is substituted by other evaluative communications among peers, like individuals of the same generation. Each person belongs to a reference social group with individuals that interact more intensively. Humans have developed psychological mechanisms that enable cultural transmission by being receptive to parental advice as well as their reference social group. The selective pressure that promoted these new evaluative interactions arose to facilitate the establishment of efficient cooperative relationships. In short, the social control of behavior is essential to understand human cultural transmission. (shrink)

We contrast two positions concerning the initial domain of actions that infants interpret as goal-directed. The 'narrow scope' view holds that goal-attribution in 6- and 9-month-olds is restricted to highly familiar actions (such as grasping) (). The cue-based approach of the infant's 'teleological stance' (), however, predicts that if the cues of equifinal variation of action and a salient action effect are present, young infants can attribute goals to a 'wide scope' of entities including unfamiliar human actions and actions of (...) novel objects lacking human features. It is argued that previous failures to show goal-attribution to unfamiliar actions were due to the absence of these cues. We report a modified replication of showing that when a salient action-effect is presented, even young infants can attribute a goal to an unfamiliar manual action. This study together with other recent experiments reviewed support the 'wide scope' approach indicating that if the cues of goal-directedness are present even 6-month-olds attribute goals to unfamiliar actions. A pesquisa "Perfil do Estudante da PUC-MG" foi concebida para oferecer dados e subsídios ao Serviço de Pastoral da Universidade - SPU PUC Minas. Coordenou a pesquisa o prof. Paulo Agostinho N. Baptista, que atuou junto aos professores Euclides Guimarães Neto e Maria Clara Baeta Galuppo na análise e redação do relatório. Ainda da PUC Minas, foram consultores os professores Pe. Alberto Antoniazzi, Maria Beatriz Ribeiro de Oliveira Gonçalves, Elisete de Assis Rebello e Romualdo Francisco Dâmaso. O professor Carlos Eduardo (...) Rezende Jacob atuou com analista de sistema e a professora Vírginia Mata Machado como revisora. Foram entrevistados 382 estudantes (3%), dos 22 cursos existentes na universidade em 1991, num universo de 12.733 alunos. O nível de confiabilidade foi de 95% e a margem de erro variou entre 3 e 5%. Dados gerais, religião, avaliação da universidade, participação em movimentos sociais, políticos e culturais, hábitos socioculturais e avaliação das disciplinas Cultura Religiosa e Filosofia foram os dados analisados neste relatório. A pesquisa "Perfil do Estudante das Instituições Católicas de Ensino Superior" foi realizada e concebida com o objetivo de contribuir para o planejamento e o subsídio do trabalho da pastoral universitária. O projeto nasceu do interesse do setor de Pastoral Universitária da ABESC - Associação Brasileira de Escolas Superiores Católicas - em conhecer a realidade juvenil para esse planejamento pastoral. Um ano antes havia sido realizada a pesquisa "Perfil do Estudante da PUC-MG" que serviu como modelo. Participaram da pesquisa 22 (...) instituições, correspondendo ao universo de 122.917 estudantes. Porém, apenas 17 instituições (106.403), em sete estados da federação, enviaram seus dados que foram analisados neste relatório, numa amostra de 3.039 alunos (2,9%). Coordenou a pesquisa o prof. Paulo Agostinho N. Baptista, que atuou junto aos professores da PUC Minas Euclides Guimarães Neto e Maria Clara Baeta Galuppo na análise e redação do relatório. Foram consultores os professores da mesma universidade Pe. Alberto Antoniazzi, Maria Beatriz Ribeiro de Oliveira Gonçalves, Elisete de Assis Rebello e Romualdo Francisco Dâmaso. Em face da ordem política e do ordenamento jurídico, tais posições se organizam como uma hermenêutica, e esse pensamento, no caso do Direito, se desenvolve como uma interpretação.

Meditation has been for long time avoided as a scientific theme because of its complexity and its religious connotations. Fortunately, in the last years, it has increasingly been studied within different neuroscientific experimental protocols. Attention and concentration are surely among the most important topics in these experiments. Notwithstanding this, inhibition of emotions and discursive thoughts are equally important to understand what is at stake during those types of mental processes. I philosophically and technically analyse and compare results from neuroimaging studies, (...) produced by leading authorities on the theme, dealing with two types of meditation: "one-pointed concentration" and "compassion meditation". Analysing "one-pointed concentration", I show the differences between novice and expert meditation practitioners in terms of brain activity and connectivity, considering the relationship among increased attention and concentration and decreased activity in areas related to discursive thought and emotion. Analysing "compassion meditation", I show the importance of the limbic circuitry in emotion sharing. I follow the same strategy of comparing novice and expert meditation practitioners. The conclusion establishes a common structure to those different ways of dealing with emotion during meditation. (shrink)

O artigo analisa a questão da democracia em Carl Schmitt. Para tanto, retoma seu conceito de forma política que inclui identidade e representação. Após apresentar uma distinção fundamental para a noção de democracia, deriva algumas conseqüências do contraste com as idéias de Schmitt. A representação e a identidade como formas políticas constituiriam, então, uma impossibilidade para a democracia. This article analyses the question of democracy in Schmitt's work. For this purpose, it reviews his concept of political form which includes identity (...) and representation. After presenting a fundamental distinction to the notion of democracy, some consequences are derived from contrast to Schmitt's ideas. The representation and the identity as political form would constitute, consequently, an impossibility for democracy. (shrink)

We have begun work on two separate but related ontologies for the study of neurological diseases. The first, the Neurological Disease Ontology (ND), is intended to provide a set of controlled, logically connected classes to describe the range of neurological diseases and their associated signs and symptoms, assessments, diagnoses, and interventions that are encountered in the course of clinical practice. ND is built as an extension of the Ontology for General Medical Sciences — a high-level candidate OBO Foundry ontology that (...) provides a set of general classes that can be used to describe general aspects of medical science. ND is being built with classes utilizing both textual and axiomatized definitions that describe and formalize the relations between instances of other classes within the ontology itself as well as to external ontologies such as the Gene Ontology, Cell Ontology, Protein Ontology, and Chemical Entities of Biological Interest. In addition, references to similar or associated terms in external ontologies, vocabularies and terminologies are included when possible. Initial work on ND is focused on the areas of Alzheimer’s and other diseases associated with dementia, multiple sclerosis, and stroke and cerebrovascular disease. Extensions to additional groups of neurological diseases are planned. The second ontology, the Neuro-Psychological Testing Ontology (NPT), is intended to provide a set of classes for the annotation of neuropsychological testing data. The intention of this ontology is to allow for the integration of results from a variety of neuropsychological tests that assay similar measures of cognitive functioning. Neuro-psychological testing is an important component in developing the clinical picture used in the diagnosis of patients with a range of neurological diseases, such as Alzheimer’s disease and multiple sclerosis, and following stroke or traumatic brain injury. NPT is being developed as an extension to the Ontology for Biomedical Investigations. (shrink)

We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. Niche construction theory highlights the active role of organisms in modifying their environment. A subset of these modifications is the developmental niche, which concerns ecological, epistemic, social and symbolic legacies inherited by organisms as resources that scaffold their developmental processes. Since in this theory development is a situated process that takes place in a culturally structured environment, we may reasonably ask if implicit cultural biases may, in some cases, be responsible for maladaptive developmental niches. In this paper we wish to (...) argue for an affirmative answer. In order to do so, we first propose to conceptualize implicit bias as embodied perceptual habits, and then proceed to show that these habits are at least partially responsible for maladaptive developmental niches of children with Down syndrome and autism. With this framework we thus hope to bring together two fields of research that haven’t been explicitly connected: implicit bias and niche construction theory. Linking these two theories may bring benefits both to implicit bias researchers, who can extend this concept to characterize other sets of processes as biased, as well as to niche construction theorists, who will have a useful theoretical tool to diagnose maladaptive features of niches brought about by sociocultural biases. In this paper, we defend that demonstratives are expressions of joint attention. Though this idea is not exactly new in the philosophical or linguistic literature, we argue here that their proponents have not yet shown how to incorporate these observations into more traditional theories of demonstratives. Our purpose is then to attempt to fill this gap. We argue that coordinated attentional activities are better integrated into a full account of demonstratives as meta-pragmatic information. Our claim is twofold. First, we claim (...) that pragmatically presupposing salience is a fundamental aspect of using demonstratives. Secondly, we hold that the pragmatics of demonstrating can only be properly understood in relation to meta-pragmatic conditions that have to do with joint attention. We use tests of truth-value gap as evidence for our claim. Our proposal provides us with a complete view of what speakers do and presuppose when engaging in acts of demonstrative reference through language. (shrink)

Este artigo visa compreender o estado da arte do naturalismo contemporâneo a partir da discussão com posições não naturalistas, em especial as de Moore e Rawls. Parte-se da análise do argumento central destas abordagens no contexto formal da metaética contemporânea, buscando aferir a validade da falácia naturalista no contexto atual, bem como de seus limites na aplicação contra o naturalismo moral. Apresenta-se a discussão entre o naturalismo e o não-naturalismo moral como, respectivamente, estandartes das perspectivas descritivas e prescritivas da moralidade. (...)
